Workmans comp vs auto insurance

I'm not an insurance expert but those who may be will need more information. For example:

- Who fault was it, and why?

- Did the s/o sign anything where he accepted liability for the patrol car?

There may be more questions to.

A s/o was involved in a horrific accident and almost near died. After his recovery he had sued the other drivers insurance for pain and suffering. Inturn the company tried to sue the s/o for the patrol vehicle that was totaled but did not recieve judgement for there claim.

Just out of curiousity how do other state workers comp and auto insurance carriers work these types of settlements out.
