    Depends on the state. Generally speaking, the company can be sued for lots and lots of money. In states that make such activity illegal, the operator can be imprisoned for several years.

      Depending upon the type type of information illegally taken or grossly mishandled, federal law kicks in. If it results in ID theft or credit card theft, Secret Service is all over it.
