On the surface it seems like a pretty clear cut case. The clerk was wrong to shoot at a fleeing subject. Even if he did have a gun on him he was eliminating a deadly threat by leaving and until he pulled the gun and took aim at the clerk then the clerk will have a hard time convincing a jury that he feared for his life by a fleeing man. Maybe he can get a job at the canteen in the big house as a clerk.

I've had suspects do the exact same thing when I've gone to stop them. I had a female that tried to run and when I grabbed her, she said, "I'm gonna pull out my piece and bust a cap in you!" At a different store, an officer had a guy state he had a gun and reach into his clothing.
My female suspect got placed into handcuffs and was lucky she didn't kiss pavement. And, no, she didn't have a gun, either. The responding police officer did charge her with felony harassment for the threat, however.

During a brief struggle, Huddleston reached inside his shirt as if he had a gun, according to a police news release. He then ran outside to a car parked near the gas pumps.
Bilbrey, 45, of south Nashville followed and fired two shots at Huddleston with a .38-caliber revolver. Huddleston, who was not armed, was transported to an area hospital, where he was pronounced dead. Bilbrey has a valid permit to carry a handgun, police said.Tags: None
