On the surface it seems like a pretty clear cut case. The clerk was wrong to shoot at a fleeing subject. Even if he did have a gun on him he was eliminating a deadly threat by leaving and until he pulled the gun and took aim at the clerk then the clerk will have a hard time convincing a jury that he feared for his life by a fleeing man. Maybe he can get a job at the canteen in the big house as a clerk.

I've had suspects do the exact same thing when I've gone to stop them. I had a female that tried to run and when I grabbed her, she said, "I'm gonna pull out my piece and bust a cap in you!" At a different store, an officer had a guy state he had a gun and reach into his clothing.

My female suspect got placed into handcuffs and was lucky she didn't kiss pavement. And, no, she didn't have a gun, either. The responding police officer did charge her with felony harassment for the threat, however.

We always hear about shoplifters shooting the LP, but here is one where the clerk shoots first.

During a brief struggle, Huddleston reached inside his shirt as if he had a gun, according to a police news release. He then ran outside to a car parked near the gas pumps.

Bilbrey, 45, of south Nashville followed and fired two shots at Huddleston with a .38-caliber revolver. Huddleston, who was not armed, was transported to an area hospital, where he was pronounced dead. Bilbrey has a valid permit to carry a handgun, police said.
